    Roskomnadzor blocked Bestchange

    Bestchange was blocked by Roskomnadzor for Russian users on March 11 in accordance with the decision of the Kuybyshevsky District Court of Omsk dated July 24, 2018. The popular portal for searching exchange services, including cryptocurrency exchange .

    According to the decision , Bestchange and a number of similar services offer “ Bitcoin “ e-currency ”services ( Bitcoin) , which is a virtual means of payment and accumulation. The specified cryptocurrency is not provided with real value, does not contain information about its holders (all its use is anonymous). ”

    The plaintiff in the person of the prosecutor of the city of Omsk made a statement, asking to recognize the information posted on these sites, illegal for distribution in the territory of the Russian Federation, which the court decided to satisfy.

    In its decision, the court refers to Art. 27 of the Federal Law of 10.07.2002 No. 86-ФЗ “On the Central Bank of the Russian Federation”, according to which the official currency in the territory of the Russian Federation is the ruble, and “the introduction of other monetary units and the issuance of monetary surrogates are prohibited”.

    "In such circumstances, cryptocurrencies , including Bitcoin, are money substitutes, contribute to the growth of the shadow economy and cannot be used by citizens and legal entities on the territory of the Russian Federation," the decision says.

    The court also refers to the position of the Central Bank, according to which “the use of cryptocurrency in transactions is the basis for considering whether such transactions are aimed at financing terrorism”, and “the provision of virtual currency exchange services by Russian legal entities will be considered into conducting suspicious operations in accordance with the legislation on countering the financing of terrorism. ”

    “Thus, this activity is contrary to the Federal Law of 07.08.2001 No. 115-ФЗ“ On Counteracting the Legalization (Laundering) of Criminally Income and the Financing of Terrorism ”.”

    In May 2017, guided by similar arguments, the decision to block the Bestchange, along with 39 other sites of a similar focus, was issued by the October Court of St. Petersburg.
