FTX Trading and 101 affiliated debtors selected Kroll Restructuring Administration as their claims and noticing agent after filing for Chapter 11 protection in November 2022. FTX announced on November 17 that official filings would be published through the case website administered by Kroll. The appointment was part of the bankruptcy procedure in the U.S. Bankruptcy Court for the District of Delaware, case number 22-11068.
A claims and noticing agent performs administrative work that would otherwise fall to the court clerk in a case with a large creditor population. That includes receiving proofs of claim, maintaining a register and sending notices to creditors and other parties in interest. The presence or amount of an entry on the register does not by itself mean that a claim has been allowed or that it will be paid in full.
What the appointment did not establish
At that early stage, FTX had not announced a distribution timetable or a recovery percentage for customers. The number and value of claims visible in the initial register were incomplete and could not be used to calculate the company’s total liabilities. Statements that customers would necessarily wait a specific number of years, or that a particular dollar amount would be recovered, were estimates rather than court findings.
The FTX Group had filed its Chapter 11 petitions on November 11. The claims-agent appointment did not combine every FTX entity worldwide into one proceeding, resolve disputes with Bahamian liquidators or decide the legal priority of customer claims. Those questions depended on later filings and court orders.
