Kiev-registered company SpetsHesh won a trial at the local customs, which more than tripled the VAT on the clearance of four ASIC miners. This reports the Youtube channel BlockchainTalk.
In April 2018, SpetsHesh bought four Antminer S9 devices at a price of $ 350 per unit, but Kiev customs required to pay tax on the basis that each ASIC costs $ 1,050. Since for customs clearance VAT is charged at a rate of 20% of the cost, in total, SpetsHesh had to pay a tax of $ 920. With proper customs clearance, the amount should not exceed $ 280.
Overpay the company did not want and went to court. SpetsHesh had to prove his case for almost a year and a half, taking into account the adjournment of meetings and the consideration of appeals. At the same time, the company could not use the equipment, the cost of which during this period decreased to $ 150.
“We won the trial, but I don’t intend to customs clearance the equipment, because now it costs $ 150-200, ” said Oles Slobodenyuk, owner of SpetsHesh.
Lawyer Nikita Zavyalov, who represented SpetsHesh in court, is convinced that their case created a judicial precedent that would not allow customs in the future to artificially raise the price for customs clearance of mining equipment.
It is noteworthy that in fact the cost of Antminer S9 at the end of March 2018 was at least $ 1,160.
Recall that in January 2018, a batch of ASIC miners in the amount of 13 million hryvnia was seized at the Boryspil airport.
