
The court sent an appeal to Roskomnadzor to unblock the online aggregator of cryptocurrency exchangers Bestchange.ru. This is reported by the head of the PR and marketing department of Bestchange.ru Nikita Zuborev, RBC reports.
According to him, the prosecutor's office of Omsk refused the claim for the suspension of the site in connection with the new provisions of the Russian legislation aimed at the legalization of cryptocurrencies. In particular, we are talking about the federal law “On digital rights” and the draft law “On digital financial assets”.
At the same time, Bestchange.ru plans to review the case of blocking its resource in the court of first instance, Sarkis Darbinyan, a lawyer for the resource, partner of the Center for Digital Rights, said in a BlockchainJournal comment:
“We asked the court to completely terminate the proceedings. However, the court denied this to us, explaining that the decision involved other sites whose owners were not involved in the process. In addition, the application was filed in defense of an indefinite number of persons, and allegedly, in order to check whether the refusal of the claim does not violate their rights, the case should be reviewed by the court that made the decision. Therefore, the court decision was canceled, and the case was sent for a new consideration, ”the lawyer said.
However, the lock should be lifted in the coming days even before re-examination.
“All this time, the portal continued to work thanks to technical ways to bypass the blocking, some users did not even notice the changes. However, the Bestchange.ru team is now trying to speed up unlocking, ”said Nikita Zuborev.
Recall that Bestchange.ru crypto-exchangers aggregator has been repeatedly entered into the register of prohibited sites since 2017 .
The last time the resource was blocked by Roskomnadzor on March 12, 2019 on the basis of the decision of the Kuibyshev regional court of the city of Omsk of July 24, 2018, in which, among other things, bitcoin is recognized as a surrogate, and the dissemination of information about it is illegal.
The law “On Amendments to Part One, Second and Third Civil Code of the Russian Federation”, which enshrines the concept of “digital law” and regulates the use of smart contracts, was adopted by the State Duma deputies on March 12.
The draft federal law “On digital financial assets” was adopted in the first reading on May 22, 2018. The date of the second hearing has not yet been determined, but should take place within the framework of the spring session of the State Duma.
